orionflood Posted July 29, 2014 Report Share Posted July 29, 2014 So I'm on a long show and now they are starting to put in a broll day in every week and cutting me within 24hrs most times since they aren't sure which day it'll be per week. I'm not sure how to respond since it is a long show and not sure how cancellation policy works on non union reality. Anybody had this issue? On a non-union show it is whatever you negotiate in writing. If you haven't negotiated any kind of cancelation fee in advance you probably won't get anything better than the pitiful Union Contract agreement which is shown below. 15. Change and Cancellation of Calls (a) Calls for Daily Schedule and Weekly Schedule sound employees and “On Production” projection employees may be changed or cancelled if made: (1) before 8:00 p.m. of the day preceding the call for any day other than the sixth or seventh day worked in the employee's workweek; or (2) with six (6) hours notice on the day of the call, provided that such notice is given after 7:00 a.m. on the day of the call. ( Calls for “Off Production” projection employees may be changed if made (1) before 8:00 p.m. of the day preceding the call for any day other than the sixth or seventh day worked in the employee’s workweek; or (2) with six (6) hours notice on the day of the call, provided that such notice is given after 7:00 a.m. on the day of the call. © With respect to all sound department employees and Weekly in the employee's workweek may be cancelled before 8:00 p.m. on the day preceding the day of the call. (d) If, at the time of a call, the employee called is not on the employer's payroll, such call may not be cancelled. The foregoing shall be applicable whether such employee is an "On Production" or "Off Production" employee. taylormadeaudio Posted July 29, 2014 Report Share Posted July 29, 2014 There's not much you can do - like Tom said, either quit the gig (or threaten to)... or accept it and possibly re-negotiate next "season"... though they will likely just hire someone else and do the same thing to them. For future reference, maybe make sure the deal memo has some of your interests listed as well - contracts should be mutually beneficial... so you could include provisions for cancellations, guaranteed hours, etc... union or not - there should still be some kind of deal memo. ~tt Quote Link to comment Share on other sites More sharing options...

Nowadays - if its a new, long-running show - I make sure to negotiate a flat weekly rate for my gear. In the event that production suddenly institutes a b-roll day, I still get my full kit rental. Instead of assuming they won't pay them, ask for them, and let production know you expect a cancellation fee unless they cancel 48 (or 24) hours ahead of time. You can't get what you don't ask for.
